We are applying to NBD for permission to grant patent for a resource, categorised under the Bio diversity Act. The NBD in turn has sent us an agreement which also mentions about monetary sharing if we commercialise the product. Rule 14 of the NBD rules prescribes form 1 for permission to commercialise. So why is NBD talking about commercilisation under Rule 18. Does it imply that we do not have to apply again under Form 1 for Commercialisation. Also before commercialisation we need to take permission of the State Board. Will State Board again ask us to sign a separate agreement for monetary sharing. Can we negotiate with NBD for a higher percentage in monetary sharing so as not to enter into separate agreement with states for monetary sharing.Last question. Can NBD grant permission to commercialise under Rule 18, when there is a separate provision under Rule 14 of NBD rules

Under these circumstances is the Supreme Court ruling in K. Krishnan vs. State of Karnataka (2000) on vehicle release apply to Meghalaya or not. And also when a vehicle is seized and offenders unknown can the Court directly release forest offence vehicles without a seizure list and without the forest offenders coming to the department to claim the vehicle and co-operate with investigation?

2] Hearty congratulations for planning special administration plan for preventing oil spill in the deep seas by Shri Manohar Parrikar, Honorable Minister for Defense. As referring to the above subject, one of the main reasons of Oil spillage in the deep seas is due to the Hazardous Waste Oil discharged illegally and thrown out to get rid by the vessels calling at Mormugao Port and Panaji Port. This Hazardous Waste Oil is generated by the vessels during their voyage. We would like to suggest some procedures to avoid such Hazardous Waste Oil spillage in deep seas. 1. Mandatory discharge of Hazardous Waste Oil for the vessels calling at Mormugao Port and Panaji Port which will empty the sludge tanks of the vessels. 2. Special permissions for quick and fast movement for discharge of Hazardous Waste Oil by Mormugao Port Trust and Customs Department. Time restraint which is one of the main reason the vessels deny to discharge Hazardous Waste Oil at the port. Such procedures are mandatory in European countries in accordance with MARPOL Act 73-78. Keeping Goan waters free from pollution of oil spillage let we be a part of it. Please do take note and imply the above suggestions. It was also noticed and realized by the Goa State Pollution Control Board that recycling units located outside the state of Goa are not filling records of returns regularly to Goa state pollution control Board. As per their (GSPCB) circulars:- 1. Circular No 10/2/11-PCB/VOL.VIII/62 dated 02/04/2013. 2. Circular No 10/2/11-PCB/VOL.VII/946 dated 23/05/2013. Hence, it is also requested to obtain a NOC to the recyclers units based only in State of Goa.
